Cancellation Conditions and Right of Withdrawal

These conditions set out the terms for cancelling an order and exercising the right of withdrawal for purchases made on piscine-sav.com, a website operated by the company MV (trading as Piscine SAV). They supplement the General Terms and Conditions of Sale, which prevail in the event of any discrepancy.
1. Cancellation before dispatch
Before dispatch, the Customer may request the cancellation of their order from Piscine SAV by e-mail to contact@sas-mv.com or via the Site's contact form. If the cancellation is accepted, all sums paid (price of the product(s) and delivery charges) are refunded in full within a maximum of 14 days. No additional charge applies when the cancellation takes place before dispatch.
Once the parcel has been dispatched, the order can no longer be cancelled: the consumer Customer may then exercise their right of withdrawal after receipt (section 2).
2. Right of withdrawal after receipt
In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the consumer Customer has a period of 14 days from receipt of the last product in their order to withdraw, without having to give any reason for their decision. They inform Piscine SAV of their decision via the online returns form in their customer account, by e-mail (contact@sas-mv.com) or by post (Piscine SAV — MV, Route de Tillac D3, Zone industrielle, 32230 Marciac, France), then return the products within 14 days of their request.
Products must be returned complete, in their original packaging and in their original condition. Any depreciation resulting from handling other than that necessary to establish their nature, characteristics and proper functioning may be deducted from the refund. Return costs remain payable by the Customer.
Piscine SAV refunds all sums paid, including the initial delivery charges at the cost of the cheapest standard delivery method offered. The refund is made within a maximum of 14 days after receipt and inspection of the products at our premises; mere proof of dispatch is not sufficient to trigger it.
The following are, in particular, excluded from the right of withdrawal: products made to measure or clearly personalised, products unsealed after delivery which cannot be returned for reasons of hygiene or health protection, and products liable to deteriorate or expire rapidly (Article L. 221-28 of the French Consumer Code). Business Customers do not benefit from the right of withdrawal.

3. Cancellation by the seller
Piscine SAV may cancel an order in the event of product unavailability, an obvious pricing error, an unsettled non-payment on a previous order or a serious suspicion of fraud (Article 5 of the General Terms and Conditions of Sale). The Customer is informed as soon as possible and the sums paid are refunded in full within a maximum of 14 days.
4. Parcel not collected or refused
At a pick-up point or parcel locker, the parcel is held for the holding period set by the carrier (Mondial Relay and InPost: 5 calendar days; DPD Pickup point: 9 calendar days; Colissimo: 14 days at a post office or Pickup point, 5 working days in a locker), then returned to Piscine SAV. Failure to collect or refusal of the parcel does not constitute withdrawal.
Where the failure to collect or refusal of the parcel is attributable to the Customer, the initial delivery charges are not refunded and the return costs invoiced by the carrier remain payable by the Customer. The Customer may request that their order be re-sent upon payment of new delivery charges; failing this, they are refunded the price of the products, less the return costs (Article 7.7 of the General Terms and Conditions of Sale).
5. Transfer of risk
For the consumer Customer, the risk of loss or damage is transferred when they take physical possession of the products (Article L. 216-2 of the French Consumer Code). It is recommended to check the condition of the parcel and its contents on delivery, to record specific reservations on the delivery note in the event of any anomaly and to report them to Piscine SAV upon delivery, with supporting photographs.
6. Delivery areas and restrictions
Products are delivered in mainland France (including Corsica and the islands for standard parcels; bulky products or products over 30 kg on quotation) and in the European Union countries and Monaco listed in Article 7.1 of our General Terms and Conditions of Sale. For the French overseas territories, online ordering is not available: shipping may be considered on quotation from customer service (contact@sas-mv.com). PO boxes and military addresses cannot be served.
Depending on the delivery address, free collection by appointment from the Marciac shop (32230) may also be offered among the delivery methods when ordering.
