General Terms and Conditions of Sale

Edition of 1 October 2026 — cancels and replaces the edition of 26 September 2026.

Article 1 — Identity of the seller

The website piscine-sav.com (hereinafter “the Site”) is operated under the trading name Piscine SAV by:

MV, a simplified joint-stock company (société par actions simplifiée) with share capital of €1,000, registered with the Auch Trade and Companies Register (RCS) under number 812 607 216 (SIRET 812 607 216 00023, intra-Community VAT number FR06 812 607 216, APE code 4690Z), whose registered office is located at Route de Tillac D3, Zone industrielle, 32230 Marciac, France (hereinafter “Piscine SAV” or “the Seller”).

Contact: contact@sas-mv.com — Telephone: 05 62 03 58 57 (standard-rate call).

Article 2 — Purpose and scope

These general terms and conditions of sale (“GTCS”) govern, without restriction or reservation, all sales concluded on the Site between Piscine SAV and any purchaser, whether a consumer or a business (“the Customer”).

They are accessible at any time on the Site. They prevail over the general purchasing conditions of business Customers, unless Piscine SAV has given prior written agreement, and apply without prejudice to the information appearing on the product pages or to mandatory statutory provisions.

Validation of an order entails full and complete acceptance of these GTCS, in the version in force on the date of the order. The Customer may save or print them.

Certain provisions of these GTCS apply only to consumer Customers (in particular the right of withdrawal and the legal guarantees under the French Consumer Code); others apply only to business Customers (Article 14). Non-professionals (legal entities not acting for professional purposes) benefit only from those provisions of the French Consumer Code that the law makes applicable to them, in particular the legal guarantee of conformity (Article L. 217-32); the right of withdrawal, which the law reserves to consumers, is not available to them.

Status as a business Customer. A Customer who provides a SIRET, RCS or intra-Community VAT number when placing their order declares that they are acting for purposes falling within the scope of their professional activity. Piscine SAV, which cannot know the use to which the Customer intends to put the products, contracts in reliance on this declaration: the order is governed by the provisions applicable to business Customers, in particular Article 14 (no right of withdrawal). The Customer is solely responsible for the accuracy of their declaration; having given Piscine SAV the legitimate impression that they were acting for professional purposes, they may not subsequently invoke consumer status against it. The Customer is liable to Piscine SAV for any inaccurate declaration, in particular for the VAT that should have been invoiced, which Piscine SAV may re-invoice to them.

Article 3 — Products

The products offered for sale are described on the Site as accurately as possible (description, characteristics, photographs). The photographs illustrate the products as faithfully as possible; minor variations in packaging presentation may exist, at the manufacturers' initiative, without any change to the characteristics of the product. In the event of a difference between the product delivered and the characteristics presented on the Site, the Customer benefits from the legal guarantees and, if a consumer, from the right of withdrawal. In the event of an obvious error in a description or price, Piscine SAV informs the Customer and offers either to maintain the order on the corrected terms or to cancel it with a full refund.

Product offers are valid while stocks last. For products not held in stock, offers are valid subject to availability from Piscine SAV's suppliers; a longer delivery time is then indicated on the product page.

Article 4 — Prices

Prices are stated in euros, inclusive of all taxes (TTC), excluding delivery charges. The VAT applied is that of the Customer's country of delivery, in accordance with the European regime for intra-Community distance sales (VAT “OSS” — One Stop Shop), at the rate in force on the date of the order; the exact amount appears on the order summary and on the invoice.

For deliveries to destinations outside the territory of application of European Union VAT (in particular the overseas territories), any local taxes, import duties and customs clearance fees (local VAT, dock dues (octroi de mer), etc.) are not included in the price and remain payable by the receiving Customer.

Delivery charges are shown to the Customer before final validation of the order, according to the destination, the weight and dimensions of the parcel and the delivery method chosen. The total amount due (products + delivery) is displayed on the order confirmation page.

The applicable prices are those displayed on the Site at the time the order is validated. Piscine SAV reserves the right to change its prices at any time with future effect.

Article 5 — Orders

The ordering process on the Site comprises the following steps: selection of products and addition to the basket; checking the contents of the basket; login or account creation; choice of delivery address and delivery method; choice of payment method; review of the order summary with the possibility of correcting any errors; acceptance of the GTCS; final validation of the order by payment.

The sale is concluded upon final validation of the order by payment. Piscine SAV sends the Customer, without delay and by e-mail, an acknowledgement of receipt of the order, which Piscine SAV recommends that the Customer keep.

Piscine SAV may cancel an order only in the event of product unavailability, an obvious pricing anomaly (under the conditions of Article 3), an unsettled non-payment on a previous order or a serious suspicion of fraud. The Customer is informed as soon as possible and the sums paid are refunded in full.

Article 6 — Payment

The price is payable in full when the order is placed. The accepted methods of payment are:

  • Bank card (CB, Visa, Mastercard) — secure payment with 3D Secure authentication;
  • PayPal;
  • Bank transfer — the order is prepared and dispatched upon actual receipt of the funds. If the funds are not received within seven (7) days of the order, the order is automatically cancelled and the Customer is informed accordingly.

Payment data are processed exclusively by Piscine SAV's authorised payment service providers, via an encrypted connection; Piscine SAV never has access to bank card numbers. No cash-on-delivery shipments are accepted.

If payment authorisation is refused, the order is automatically cancelled.

Article 7 — Delivery

7.1 Delivery areas

Products are delivered to the following countries and territories:

  • Mainland France, including Corsica and the other islands of metropolitan territory for standard parcels (parcels delivered by postal service, up to approximately 30 kg). Bulky products or products over 30 kg are not offered for delivery to Corsica and the islands when ordering online; their shipment may be considered on request from customer service (contact@sas-mv.com) and is then subject to a transport quotation for the Customer's acceptance;
  • French overseas territories (Guadeloupe, Martinique, French Guiana, Réunion, Mayotte, Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, French Polynesia): online ordering is not available for these destinations. Shipping may be considered on request from customer service (contact@sas-mv.com) and is subject to a quotation for the Customer's acceptance. These shipments are invoiced exclusive of French taxes: any local VAT, dock dues (octroi de mer), customs duties and clearance fees, as well as the cost of the customs declaration prepared by Piscine SAV, are payable by the Customer; charges known in advance are stated in the quotation. Certain products (in particular treatment chemicals, aerosols, adhesives and products containing lithium batteries) cannot be shipped to these destinations owing to transport regulations;
  • Europe (European Union and Monaco): Germany, Austria, Belgium, Croatia, Denmark, Spain, Estonia, Finland, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Monaco, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Sweden.

Owing to their weight or dimensions, certain products may be deliverable only to certain areas; where applicable, this is indicated at the latest when the delivery method is chosen. Deliveries are not made to PO boxes or military addresses (postal sectors).

Depending on the Customer's delivery address, free collection by appointment from the Marciac shop (32230) may also be offered among the delivery methods when ordering; this method is available only when it is displayed at the time the delivery method is chosen.

7.2 Delivery address and Customer information

The Customer is solely responsible for the accuracy and completeness of the delivery information they provide when ordering: full address (street number and name, building, floor, postcode, town), door code or access instructions where applicable, and a mobile telephone number, which is mandatory: it is passed on to the carrier for delivery tracking by SMS (dispatch and delivery notifications, availability at a pick-up point, appointment booking for bulky deliveries). This number is used solely for the purposes of delivery, under the conditions of Article 12. The Customer may check and correct this information until the order is validated, and must notify Piscine SAV without delay of any error noticed before dispatch.

The delivery information (name, address, access code, telephone number, e-mail address) is entered by the Customer under their sole responsibility. In accordance with Article L. 221-15 of the French Consumer Code, the professional “may be exempted from all or part of its liability by proving that the non-performance or improper performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure”. Accordingly, where Piscine SAV establishes, in particular by means of the tracking history and the reason for return given by the carrier, that the failure or delay in delivery results from an incorrect, incomplete or fictitious address, or from a telephone number that is false, unassigned or does not belong to the recipient, provided by the Customer, its liability is excluded. If the parcel is returned to Piscine SAV for this reason, Piscine SAV informs the Customer by e-mail: the initial delivery charges are not refunded and the return costs invoiced by the carrier are payable by the Customer. The Customer may have the order re-sent upon prior payment of new delivery charges. Failing payment within fifteen (15) days of a formal notice sent by e-mail stating that, failing payment, the sale will be terminated, Piscine SAV may terminate the sale by notification (Article 1226 of the French Civil Code); it then refunds the price of the products, less the return costs, within fourteen (14) days of that notification.

7.3 Delivery methods and times

Piscine SAV uses several carriers (in particular Colissimo, Chronopost, DPD, GLS, Mondial Relay, InPost, and Geodis for bulky parcels). The available delivery methods, their rates and their delivery times are presented to the Customer before the order is validated.

Piscine SAV delivers on the date or within the period indicated on the Site and at the time of ordering. Failing any such indication, Piscine SAV delivers the products without undue delay and at the latest within thirty (30) days of the conclusion of the sale, in accordance with Article L. 216-1 of the French Consumer Code.

In the case of delivery to a pick-up point or parcel locker, the Customer is notified when the parcel is available. The consequences of a parcel not collected within the holding period are set out in Article 7.7.

7.4 Late delivery

A postponement caused by the Customer does not constitute a late delivery attributable to Piscine SAV, in particular: where the Customer changes the delivery date, time slot, place or address directly with the carrier (via the carrier's rescheduling services); or where the carrier has invited the Customer, by SMS or e-mail, to schedule, confirm or reschedule the delivery (choice of a time slot, booking an appointment) and the Customer has not responded, as established by Piscine SAV from the carrier's history. Rescheduling at the Customer's request constitutes agreement between the parties on the new delivery date (Article L. 216-1 of the French Consumer Code). In such cases, the delivery period is suspended until the date actually rescheduled or until the Customer responds to the carrier.

If the products are not delivered on the date or by the end of the period announced, the consumer Customer may order Piscine SAV, in writing, to make the delivery within a reasonable additional period. Failing delivery within this new period, the Customer may terminate the contract in writing; the contract is terminated upon receipt of that written notice by Piscine SAV. The contract may, however, be terminated immediately, without any additional period, if Piscine SAV refuses to deliver or if it is clear that it will not deliver, or if the delivery date constituted an essential condition of the contract for the Customer. Piscine SAV then refunds all sums paid no later than fourteen (14) days following the termination (Articles L. 216-6 and L. 216-7 of the French Consumer Code).

7.5 Transfer of risk and receipt

For consumer Customers, the risk of loss of or damage to the products passes to the Customer when the Customer (or a third party designated by the Customer, other than the carrier) takes physical possession of them (Article L. 216-2 of the French Consumer Code). Where the Customer entrusts delivery to a carrier of their own choosing other than those offered by Piscine SAV, the risk passes upon handover to the carrier (Article L. 216-3 of the same Code).

The Customer is advised to check on delivery, in the presence of the carrier where possible, not only the external condition of the parcel but also its contents. Piscine SAV ships its products in new packaging: a crushed, punctured, deformed or opened box is therefore never normal and should lead the Customer to open the parcel and inspect the goods before signing the delivery note — the Customer is not ordering a box, but the products it contains. In the event of damage or missing items, it is recommended to record specific and detailed reservations on the delivery note (stating the condition of the product itself, for example “product broken”, rather than simply “parcel damaged”), to refuse the parcel in the event of significant damage, and to inform Piscine SAV as soon as possible (contact@sas-mv.com), with supporting photographs, in order to facilitate the handling of the claim with the carrier.

The Customer is asked to report any damage to Piscine SAV upon delivery and no later than noon on the following day: carriers grant Piscine SAV only very short time limits to lodge its own reservations and claims, and immediate reporting by the Customer makes it possible to preserve this recourse. Any damage claim reported within this time limit, with supporting photographs, receives priority handling (expedited reshipment or replacement). This reporting time limit is a recommendation: exceeding it does not deprive the consumer Customer of their legal guarantees or of their rights hereunder.

For business Customers, any apparent damage or missing items must be reported to Piscine SAV no later than 12 noon on the day following delivery. It is also the responsibility of the business recipient to inspect the goods on receipt and to notify the carrier, by extrajudicial act or by registered letter, of any reasoned protest within three (3) days, excluding public holidays, following the day of receipt, under the conditions of Article L. 133-3 of the French Commercial Code.

7.6 Partial delivery

If part of the order is unavailable, Piscine SAV may make a partial shipment after informing the Customer; the shipping costs of the additional shipment(s) are borne by Piscine SAV. The Customer may prefer a refund for the unavailable products, made under the statutory conditions.

7.7 Delivery to a pick-up point or parcel locker — parcel not collected

Where the Customer chooses delivery to a pick-up point or parcel locker (locker), the collection point selected when ordering constitutes the agreed place of delivery. Piscine SAV performs its carriage service by having the parcel delivered to that collection point, where it is made available to the Customer. The Customer is informed of this by the carrier, by e-mail and/or SMS, and receives the information needed for collection, including, where applicable, a collection code.

Upon dispatch, Piscine SAV sends the Customer, by e-mail, a dispatch confirmation stating the name of the carrier and the parcel tracking number. This tracking link is also accessible at any time in the customer account on the Site, under “Order history and details”. The Customer can thus follow the progress of their parcel to the collection point.

The Customer undertakes to collect their parcel within the holding period of the collection point. This period is set by the carrier chosen by the Customer when ordering; as at the date hereof, it is:

  • Mondial Relay (Point Relais and Locker) and InPost (locker): 5 calendar days;
  • DPD Pickup point: 9 calendar days from deposit at the pick-up point;
  • Colissimo: 14 days at a post office, 14 working days at a Pickup point, 5 working days in a locker.

This period, restated in the notice of availability, constitutes the agreed term for taking delivery. Taking delivery of the goods is an obligation of the buyer: “In the sale of foodstuffs and movable effects, the sale shall be terminated as of right and without formal notice, for the benefit of the seller, after the expiry of the term agreed for taking delivery” (Article 1657 of the French Civil Code). This article has no effect on the transfer of risk provided for in Article 7.5.

Failure to collect or refusal of the parcel does not constitute exercise of the right of withdrawal. Withdrawal requires a declaration by the Customer: “The consumer exercises their right of withdrawal by informing the professional of their decision to withdraw by sending, before the expiry of the period provided for in Article L. 221-18, the withdrawal form mentioned in 7° of Article L. 221-5 or any other unambiguous declaration expressing their wish to withdraw” (Article L. 221-21 of the French Consumer Code). For a sale of goods, this period runs from receipt of the goods by the consumer (Article L. 221-18 of the same Code): a parcel that has not been collected has not been received.

If the parcel is not collected within the period, it is automatically returned to Piscine SAV, which informs the Customer. Where the failure to collect is attributable to the Customer, as established by Piscine SAV from the carrier's tracking history showing that the parcel was made available at the chosen collection point and that the notice of availability was sent to the contact details provided by the Customer:

  • the initial delivery charges, which pay for carriage actually performed, are not refunded;
  • the parcel return costs invoiced to Piscine SAV by the carrier remain payable by the Customer;
  • the Customer may request that their order be re-sent, upon prior payment of new delivery charges;
  • failing this, the sale is terminated (Article 1657 of the French Civil Code) and Piscine SAV refunds the price of the products, less the return costs, within fourteen (14) days of receipt of the returned parcel.

Where this proof is not provided (collection point closed, parcel untraceable or not made available, no notice), a new delivery is made free of charge.

For products sold through a marketplace, the seller is Piscine SAV (the company MV) and not the operator of the marketplace; any complaint relating to delivery must be addressed to Piscine SAV. Piscine SAV invites the Customer to report any collection difficulty as soon as possible, so that effective action can be taken with the carrier.

Article 8 — Right of withdrawal (consumer Customers)

8.1 Principle

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the consumer Customer has a period of fourteen (14) days from receipt of the last product in their order to exercise their right of withdrawal, without having to give reasons for their decision or bear any costs other than those provided for in Articles L. 221-23 to L. 221-25 of the same Code (return costs and, where applicable, depreciation of the products).

The period runs from the day on which the product is received by the Customer or by a third party designated by the Customer, other than the carrier (Article L. 221-18 of the French Consumer Code). Withdrawal must be declared to Piscine SAV (Article L. 221-21): mere refusal of the parcel, failure to collect it from a pick-up point or return of the product without a declaration does not constitute withdrawal (see Article 7.7).

The simplest way to exercise this right is the online returns form in the customer account: the Customer logs in to their account on the Site, opens the “Order history and details” section, selects the relevant order, ticks the product(s) to be returned and validates their return request. This request, available throughout the withdrawal period, constitutes a declaration of withdrawal; the Customer can follow its status at any time in the “Merchandise returns” section of their account.

The Customer may also give notice of withdrawal by any other unambiguous declaration (letter to the registered office address or e-mail to contact@sas-mv.com), where appropriate using the model form reproduced in the appendix hereto, although its use is not mandatory.

8.2 Return of products

The Customer returns the products to Piscine SAV (Route de Tillac D3, Zone industrielle, 32230 Marciac) without undue delay and at the latest within fourteen (14) days of communicating their decision to withdraw. Return costs remain payable by the Customer. For products which, owing to their weight or dimensions, cannot normally be returned by post, the cost of return payable by the Customer will not exceed the amount of the outbound delivery charges for the order, stated in euros in the order summary before its validation.

It is recommended that the products be returned in their original packaging, complete (accessories, instructions), and by a tracked shipment delivered against signature, keeping the proof of posting: in the event of a dispute as to Piscine SAV's receipt of the return, delivery against signature is the most reliable proof, in the interest of both parties — a parcel reported as “delivered” by the carrier without a signature does not establish who received it.

On request to customer service, Piscine SAV may provide the Customer with a prepaid return label from its own carrier; the actual cost of this label is then deducted from the amount refunded. In this case, the return benefits from the tracking and delivery against signature of Piscine SAV's carrier.

Business Customers do not benefit from the right of withdrawal (see Article 14).

The Customer returns the products complete (accessories, instructions). The Customer may handle them as they would in a shop. In accordance with Article L. 221-23 of the French Consumer Code, “the consumer's liability may only be incurred in the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of those goods”: such depreciation is then deducted from the refund.

Accordingly, for products delivered in a pouch, bag or transparent packaging allowing the product to be checked without opening it (nature, reference, dimensions, colour), opening the packaging is in principle not necessary to establish the nature and characteristics of the product; except where it was necessary to check that the product works properly, a product returned unpacked or whose transparent packaging has been opened unnecessarily may give rise to a depreciation, proportionate to the loss of value observed, deducted from the refund. The same applies to any product returned assembled, installed, filled with water, used or showing signs of use. The depreciation is quantified and justified to the Customer, with supporting photographs, before the refund.

8.3 Refund

Piscine SAV refunds the Customer all sums paid, including the initial delivery charges (at the cost of the cheapest standard delivery method offered). In order to combat fraudulent returns (products that are used, damaged, incomplete or not from our shop), Piscine SAV makes the refund only after receipt and inspection of the returned products at its premises, within fourteen (14) days of such receipt. Mere proof of dispatch is not sufficient to trigger the refund. The refund is made using the same means of payment as that used for the order, unless the Customer expressly agrees to another means, and at no cost to the Customer.

8.4 Exceptions

In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised in particular for:

  • products made to the Customer's specifications or clearly personalised (made-to-measure items, cut-to-size items, etc.);
  • products which, after being unsealed by the Customer, cannot be returned for reasons of hygiene or health protection (for example hygiene or care products for animals whose seal or closure has been opened);
  • products which, after delivery and by their nature, are inseparably mixed with other items;
  • products liable to deteriorate or expire rapidly.

Article 9 — Legal guarantees

All products sold on the Site benefit from the legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), independently of any commercial guarantee.

Mandatory box (appendix to Article D. 211-2 of the French Consumer Code):

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period exceeding two years, the legal guarantee applies to that digital content or digital service throughout the intended period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;

4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until delivery of the repaired goods.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

To implement a legal guarantee, the Customer contacts Piscine SAV's customer service (contact@sas-mv.com or 05 62 03 58 57) describing the defect observed, with supporting photographs if possible. The costs of returning a non-conforming product are borne by Piscine SAV.

Certain products also benefit from a commercial guarantee from the manufacturer or importer, the duration and scope of which are specified on the product page or in the documentation accompanying the product. The commercial guarantee is in addition to the legal guarantees and in no way replaces them.

The harmonised European notice on the legal guarantee of conformity is displayed on the product pages and when ordering.

The availability or non-availability of spare parts essential to the use of the products, and where applicable the period or date until which they are available, are indicated on the product page and confirmed in writing at the time of purchase (Article L. 111-4 of the French Consumer Code). For electrical and electronic equipment and furniture items, where the manufacturer or importer has not provided this information, spare parts are deemed not to be available.

Article 10 — After-sales service outside guarantee

Repairs falling under neither the legal guarantees nor a commercial guarantee may be entrusted to Piscine SAV, which will have them carried out by repairers approved by the manufacturers or by competent repairers. The service is subject to a prior quotation for the Customer's acceptance.

Article 11 — Take-back of used products

In accordance with Article L. 541-10-8 of the French Environmental Code, for products falling within an extended producer responsibility scheme (in particular electrical and electronic equipment: pumps, pool robots, salt chlorinators, power tools, etc.), Piscine SAV takes back free of charge, upon the purchase of an equivalent new product (“1 for 1” take-back), the used product that the Customer is disposing of, by drop-off at the Marciac shop (32230), by appointment with customer service (contact@sas-mv.com). The Customer may also drop off their used products free of charge at local collection points of approved eco-organisations (in particular ecosystem.eco for electrical equipment, which lists collection points near the Customer's home), as well as at household waste recycling centres.

Article 12 — Personal data

The Customer's personal data are collected and processed by MV, as data controller, for the purposes of order management, customer relations and, subject to the Customer's consent where required, commercial prospecting, in accordance with Regulation (EU) 2016/679 (“GDPR”) and the amended French Data Protection Act (loi Informatique et libertés).

The Customer has the right of access, rectification, erasure, restriction, objection and portability in respect of their data, which they may exercise by writing to contact@sas-mv.com. The Customer may also lodge a complaint with the CNIL (www.cnil.fr).

Detailed information on the processing (purposes, retention periods, recipients, cookies) is set out in the Privacy Policy accessible on the Site, which forms an integral part of the information provided to the Customer.

Article 13 — Intellectual property

All elements of the Site (texts, photographs, illustrations, logos, structure, databases) are protected by intellectual property law and are the exclusive property of MV or its partners. Any reproduction or representation, in whole or in part, for purposes other than consulting the Site and placing orders, is prohibited without prior written authorisation.

The trade marks and logos of the manufacturers of the products sold remain the property of their respective owners.

Article 14 — Special provisions for business Customers

The provisions of this article apply exclusively to sales concluded with business Customers acting in the course of their business, including a Customer who has declared such status under the conditions of Article 2.

No right of withdrawal. The right of withdrawal provided for in Articles L. 221-18 et seq. of the French Consumer Code is reserved to consumers. Its extension to certain professionals by Article L. 221-3 of the same Code concerns only off-premises contracts; it does not apply to distance sales concluded on the Site. Except where the guarantee against hidden defects is invoked, no return is accepted without Piscine SAV's prior written agreement; where applicable, the return is made at the Customer's cost and risk, by tracked shipment delivered against signature.

Retention of title. The products delivered remain the property of MV until full payment of their price, including principal and ancillary amounts. The risks are, however, transferred to the Customer upon delivery. In the event of non-payment on the due date, Piscine SAV may reclaim the products, with the return costs remaining payable by the Customer.

Late payment. Any late payment automatically entails, without prior formal notice, the payment of late-payment penalties calculated at the interest rate applied by the European Central Bank to its most recent refinancing operation plus ten (10) percentage points, as well as a fixed indemnity for recovery costs of forty (40) euros (Articles L. 441-10 and D. 441-5 of the French Commercial Code), without prejudice to additional compensation for costs actually incurred.

Guarantees. The legal guarantees under the French Consumer Code do not apply to business Customers. The guarantee against hidden defects applies under the conditions of the French Civil Code.

Liability. With regard to business Customers, Piscine SAV's liability, except for personal injury, gross negligence or wilful misconduct and the guarantee against hidden defects owed to a Customer who is not a professional in the same field, is limited to the amount, inclusive of tax, of the order concerned; Piscine SAV is not liable for indirect losses (loss of business, turnover or reputation).

Jurisdiction. Any dispute with a Customer having the status of trader shall be submitted to the commercial court within whose jurisdiction MV's registered office is located, notwithstanding multiple defendants or third-party claims. For other business Customers, the ordinary rules of jurisdiction apply.

Article 15 — Liability — Force majeure

Piscine SAV is automatically liable to the consumer Customer for the proper performance of the obligations arising from the distance contract, under the conditions of Article L. 221-15 of the French Consumer Code.

Piscine SAV cannot, however, be held liable for non-performance or improper performance of the contract attributable to the Customer, to the unforeseeable and insurmountable act of a third party unconnected with the contract, or to a case of force majeure within the meaning of Article 1218 of the French Civil Code.

The products are intended for the use described in their documentation; it is the Customer's responsibility to comply with the installation, use and maintenance instructions provided.

Article 16 — Consumer mediation and dispute resolution

In the event of a complaint, the Customer is invited first to contact Piscine SAV's customer service (contact@sas-mv.com — 05 62 03 58 57 — letter to the registered office), which will endeavour to find an amicable solution.

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, if the disagreement persists after a prior written complaint to Piscine SAV, the consumer Customer may refer the matter free of charge to the consumer mediator to which the company MV belongs:

To be admissible, the mediation request must contain: the postal, telephone and e-mail contact details of the applicant; the name, address and membership number of the professional concerned (the company MV, trading as Piscine SAV, membership 17619/VM/2512); a brief statement of the facts; a copy of the prior complaint sent to Piscine SAV; and any document enabling the request to be examined.

Mediation is neither mandatory nor exclusive of legal action; the Customer remains free to bring proceedings before the courts.

Article 17 — Applicable law

These GTCS and the sales they govern are subject to French law. If the consumer Customer resides in another Member State of the European Union, they retain the benefit of the more protective mandatory provisions of the law of their country of habitual residence.

Failing an amicable resolution or mediation, any dispute with a consumer Customer falls within the jurisdiction of the competent courts under the ordinary rules of law; the consumer may, at their choice, bring proceedings before one of the courts having territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they resided at the time the contract was concluded or the harmful event occurred (Article R. 631-3 of the French Consumer Code).

Article 18 — Miscellaneous

Each article, paragraph and provision of these GTCS is severable: if any of them were declared null and void, unfair or unenforceable, only that provision would be deemed unwritten, the others retaining their full validity. The fact that Piscine SAV does not at any given time invoke a provision hereof does not constitute a waiver of its right to invoke it subsequently.

Piscine SAV's computerised records, kept under reasonable security conditions, are accepted as evidence of communications, orders and payments between the parties, unless proven otherwise; the Customer retains the right to provide evidence by any means.

These GTCS are drafted in French, which is their official language. The translated versions available on the Site are provided for convenience; in the event of any discrepancy or difficulty of interpretation, the French version prevails, to the extent permitted by the mandatory provisions applicable in the consumer Customer's place of residence.
